Overview

How NN Legal assists.

Court proceedings are not the only route to resolving a dispute, and are often not the fastest or most proportionate one. Mediation and arbitration offer structured alternatives suited to particular kinds of disagreement.

  • Advising on the suitability of mediation or arbitration for a given dispute
  • Preparing clients for mediation sessions
  • Representing clients in arbitration proceedings
  • Drafting and reviewing dispute resolution clauses
  • Advising on the enforceability of settlement and award outcomes

Mediation

Mediation involves a neutral third party assisting the parties to reach a negotiated settlement. It is private, generally faster than litigation, and gives the parties more control over the outcome than a court process would.

Arbitration

Arbitration involves a neutral arbitrator or tribunal making a binding decision outside the court system, typically under a process the parties have agreed to in advance, often within a commercial contract.

Choosing the Appropriate Forum

The appropriate forum depends on the nature of the dispute, any existing contractual dispute resolution clause, the relationship between the parties, and the outcome the client is seeking. We advise clients on this choice before recommending a course of action.
