Mediation
Mediation involves a neutral third party assisting the parties to reach a negotiated settlement. It is private, generally faster than litigation, and gives the parties more control over the outcome than a court process would.
Arbitration
Arbitration involves a neutral arbitrator or tribunal making a binding decision outside the court system, typically under a process the parties have agreed to in advance, often within a commercial contract.
Choosing the Appropriate Forum
The appropriate forum depends on the nature of the dispute, any existing contractual dispute resolution clause, the relationship between the parties, and the outcome the client is seeking. We advise clients on this choice before recommending a course of action.
